Statement: Eighth U.S. Circuit Court of Appeals ruling

STATEMENT (Minneapolis, Minn.) — We hope that Minnesota judges will follow the lead of Texas judges who are granting bond hearings, despite a similar Fifth Circuit Court opinion, because that’s the due process right people have. Pragmatically, we brace for more dismal conditions for detainees related to ICE bed capacity.

Constitutionally, we cite the dissent: “All three branches of government understood [federal immigration law] to maintain the distinction between unadmitted noncitizens in the interior and those arriving at the border for detention purposes. Five presidential administrations, including the Trump administration, and most immigration judges interpreted [federal immigration law] to apply only to those arriving at the border….” a “well-established understanding and application of [federal immigration law].”
