Minnesota Supreme Court restores fairness to lowest-income renters – Statement

STATEMENT (Minneapolis, Minn.) — Mid-Minnesota Legal Aid celebrates the ruling from the state’s highest court, in favor of our client, as a win for renters of subsidized housing everywhere in Minnesota. From now on, families and individuals who live in subsidized housing are no longer treated differently from people who live in market-rate units when defending evictions. The Supreme Court said that all renters should be equally protected from unnecessary evictions.

“Nichole Nalewaja stood up for herself, her neighbors and for all tenants who receive housing subsidies across the state. She challenged a 30-year-old court precedent and she won.” – Gary Van Winkle, Mid-Minnesota Legal Aid, housing attorney

“The law says that if landlords want to evict tenants for breaching a lease, they need a very good reason to do it, and they can’t take rent money at the same time. This has been the law for tenants in private tenancies for hundreds of years. Now it is once again the law for all families, even for those who live in subsidized housing. Mid-Minnesota Legal Aid’s clients will benefit from this important decision for years to come.” – Julia Zwak, Mid-Minnesota Legal Aid, managing housing attorney
