Housing attorneys win at MN Supreme Court
(Minneapolis, Minn.) — Housing attorneys Elizabeth Sauer of Central MN Legal Services, with Max Tsai, Whitney Herold and Julia Zwak of Legal Aid, fought for a tenant’s right to keep an eviction off his record and won.
In Sela v. J.H, the state’s highest court said the landlord did not have standing to challenge our client’s right to expungement. The MN statute regarding expungement grants tenants, who settle an eviction case, the right to get those records removed.
Our thanks to Wells Fargo for supporting Mid-Minnesota Legal Aid. In doing so, they are supporting legal services that keep housing options open for Minnesota families!
“Renters should not face barriers finding safe and affordable housing due to a previous eviction case in which they followed a settlement agreement. The Minnesota Legislature recognized this common sense public policy, and this ruling ensures that this statutory protection remains the law in our state.”
