Brayton v. Pawlenty
Brayton v. Pawlenty is decided, a case challenging the Governor’s use of the unallotment statute to balance the budget, which included elimination of the Special Diet Program used by low-income Minnesotans to meet medically-required diet needs. The Minnesota Supreme Court held the Governor’s action exceeded his authority. The special diet funds were reinstated. 2009
